- Purpose
- The purpose of the course is to offer students basic knowledge and qualifications in legal topics and selected legal discipline and methods that at relevant for people in leadership positions.
- Learning outcomes
- The students shall be able to: - Explain and understand how the legal system is constituted of different types of legal norms and different types of institutions - Find relevant sources of law on the most common cites and legal databases - Present an overview of how the legal system is divided into specific legal fields - Be able to solve interpretive problems related to the individual specific legal fields - Explain the content and organization of sources of law and jurisprudence, and how institutions of importance for administrative law, employment law and private law are organised. - Explain the authority and custom of the various dispute resolving bodies and the reason for the various parties to use the relevant dispute resolving bodies - Find relevant sources of law and jurisprudence in connection with in the mentioned areas of law and explain associated terminology and methodology - Analyse difficult administrative law and employment law challenges, with insight into and understanding of all current sources of law - Reflect on and argue for decisions in the specific case where the legal basis is not clear and where there is "competition" between the various reasons and authority - Perspective interfaces between administrative law and labor market law principles in connection with employment - Communicate and argue knowledge and proposed solutions in connection with administrative law and employment law in writing and orally, in a clear and distinct manner.
- Content
- The course is structured in two main parts, the first part is an introduction to law and the second part is about adminstative law and employment law. The first part is an introduction to law, and contains topics such as - what the role of jurists is or ought to be - basic (legal) philosophical concepts - basic concepts and principles in the legal system - survey of laws and public institutions - about the sources of law and about legal information seeking - the nature of legal language compared to ordinary language - how legal norms can be divided into different categories, and the importance of the divide - methodological challenges and questions connected with the interpretation of laws and other sources of law. The second part concerning administrative law and employment law will include - concepts and methods relating to administrative law - objective management, distortion of power and subjecting assessment to rules - formal management, e.g. ability, justification, hearing parties, the right to public access and private access, etc. - administrative examination and how different examination bodies are organized - basic concepts regarding employment rules and the interaction between contract employment and civil service employment - requirements in connection with employment - administrative requirements in connection with termination and disciplinary action - the interaction between the employer's management rights and the employee's rights.
- Learning and teaching approaches
- The course consists of approx. 40 hours regular class teaching. Class teaching will mainly consist of lectures, presentations, exercises and discussions.
